<p>Kent is the co-founder of RETS Associates, a recruiting firm specializing in the commercial real estate industry, and has 20 years of recruiting and real estate experience. RETS matches candidates with positions in direct hire, temporary staffing and temp-to-perm positions, primarily in the western U.S. In 2012, RETS handled 363 job orders on behalf of clients, from junior to executive levels and encompassing nearly all functional areas within the CRE industry. Prior to founding RETS, Kent worked for CB Richard Ellis from 1993-2001, serving as a Managing Director for Strategic Accounts and worked with several national pension fund advisor clients. Kent holds a Master of Business Administration degree from the University of California, Irvine, and a Bachelor of Science degree in Political Economics from the University of California, Berkeley. He is involved with a variety of industry associations, including the Urban Land Institute (ULI), BOMA, IREM and NAIOP.</p>

<p>Really, are we in the real estate business to express our individuality and artistic flair or are we doing this to make money? It may be both, but there is no denying that after years of cutting back costs just to survive, who really wants to spend a bunch of money on original design? Let&#8217;s just cut the cost and tell the architect to copy some other building. Sounds like a good idea, no? Well maybe not, and copying building designs may cost you far more than you imagined.</p>
<p>Listen as we discuss with Jeff Reichard, the world of architectural copyright protection and what architects, developers and building owners need to know when planning new development.</p>
<p>This show is not intended to be a lecture on the law. Our purpose is to give everyone involved in the development process enough knowledge to, hopefully, be able to identify warning signs of copyright infringement and how to avoid it, as well as how to protect your own buildings and design.</p>
<p>Some of the questions answered include:</p>
<ul>
<li>Can you copy the design of a building?  If so, what are the limitations imposed by law and how can you get around those limitations?</li>
<li>Who actually owns the design of a building and how do you make sure that you own the design?</li>
<li>How do you protect and enforce your rights to a design?</li>
<li>If you buy a building that is already constructed, should you have any concerns that you may have liability for copyright infringement?</li>

<p>Jeff routinely speaks to groups and publishes articles regarding various issues involving construction, patent, trademark and copyright issues. <p>Is there some way that we can get past a lot of the negotiating positioning and &#8220;beeline&#8221; it straight to the agreement or we must always do the &#8220;dog and pony show&#8221;? This will be a point/counter-point type of discussion with Ira Meislik, Joel Hall, and me taking Ira&#8217;s thoughts and suggestions for a spin, both from a landlord and a tenant perspective.</p>
<p>Is it possible to design a lease that both parties would or should agree upon without time-wasting negotiations? What would the parties be giving up to start with a lease form “pre-negotiated” to include those provisions that normally show up in a lease after weeks of negotiations? Can the parties trust each other to start with a “centrist-type” form? Does that make sense? Is it a realistic possibility?</p>
<p>In his blog posting, Ira suggests that there could be a &#8220;boilerplate&#8221; lease provision to cover many, many parts of a lease where the parties now trod through line by line. He thinks it&#8217;s possible to do that in a way that is “fair.” Somehow, I am confident that Joel and I will not entirely agree on that concept!</p>
<p>By example, what about everyone agreeing on the concept that all consents will not be unreasonably withheld unless a particular provision says otherwise?  I am not sure that I agree with that unless it is not my client’s right to consent.</p>
<p>This should be a fun and lively discussion with some creative and positive results.</p>

It&#8217;s undeniable that California legislation and propositions often serve as a model for other states to adopt or avoid and this show is a review of some of the top legislation affecting California commercial property.</p>
<p>Some of the topics discussed include:</p>

<li>Renewed efforts to implement a split roll property tax</li>
<li>AB 5 (Homeless Person&#8217;s Bill Of Rights And Fairness Act)</li>

<p>Are you aware that the CBPA engaged on 494 pieces of legislation in the California State Capitol? Of the 67 bills deemed “High Priority” three were supported or sponsored by the CBPA.</p>
<p>Governor Brown has signed California’s ADA reform measure, SB 1186 (Steinberg/Dutton) which is intended to curb lawsuit abuse regarding the Americans With Disabilities Act (ADA) while promoting increased compliance with disabled accessibility building codes. This bill is being hailed as the most comprehensive and significant reform to California’s ADA Law. Currently, California has 40 percent of the nation’s ADA lawsuits but only <em>12 percent</em> of the country’s disabled population. I will add some commentary based upon my practical experience applying the law to existing lawsuits that I am involved in.</p>
<p>Rex Hime and the CPBA do a lot to make sure that commercial property owners&#8217; interests are well represented in the state legislature. I had the opportunity to attend a meeting in Sacramento this past June with the CPBA. I must admit that I walked away with a totally new appreciation for what Rex and his staff do on our behalf (even if he does over do the Hawaiian shirt thing)!</p>

<p>Rex Hime is a native Californian, graduated from the University of California at Davis with a B.A. in Political Science and received his law degree from the UC Davis School of Law.</p>
<p>Prior to joining California Business Properties Association (CBPA), Rex served on then Governor Reagan’s educational staff and as Assistant to the Director for the State Department of Consumer Affairs. Later he was the Executive Director of the California State Commission for Economic Development, Director for the California Commission on Agriculture and as a Special Assistant to the Lieutenant Governor. His legislative experience includes service as the Senior Assistant to the Minority Leader of the California State Assembly.</p>
<p>With a membership of more than 10,000, CBPA is the designated legislative advocate for the International Council of Shopping Centers (ICSC), the California chapters of the National Association of Industrial and Office Properties (NAIOP), the Building Owners and Managers Association of California (BOMA CAL), the Institute of Real Estate Management (IREM), the Retail Industry Leaders Association (RILA), the California Downtown Association (CDA), the CCIM of Northern California, and the Association of Corporate Real Estate Executives (ACRE) of Southern California.</p>
<p>Rex helped to create the coalition that has stopped the threat of split roll taxes several times. He also provided leadership to the coalition of interests that achieved passage of the law prohibiting commercial rent control in California – making it the only state to enact such legislation. Hime also brought together a coalition of the business and disabled communities to successfully achieve passage of landmark legislation redefining the approval process for drive-throughs in California.</p>
<p>He has been involved in all statewide school construction bonds; serving either on the steering committee or on the finance committee. These measures have generated almost $50B for K-12 and higher education facility construction. Rex has been involved in the drafting of major water bond efforts and has worked for Proposition 204 (1994) and Proposition 13 (1999) and Proposition 84 (2006) serving on the steering and executive committees, as well as finance co-chair.</p>

<p>Brian Cescolini started his career as a security guard in 1974 while attending college at San Diego State University. He quickly rose through the ranks and became Vice President of a local Southern California security firm. In 1981, Mr. Cescolini helped form Universal Protection Service as an entity of a building maintenance firm and has presided over an extremely successful period of growth and prosperity, building Universal Protection Service into one of the most highly regarded and recognized security organizations in California. Mr. Cescolini&#8217;s oversees all aspects of Universal Services of America, and his background encompasses a variety of positions and many experiences he acquired while climbing the career ladder. Mr. Cescolini’s company has created a transnational security organization called Transnational Security Group, which consists of five of the largest and most respected privately owned security companies located across the country that gives Universal Protection Service national exposure to compete in the national marketplace.</p>
<p>Mr. Cescolini’s efforts have brought him a wealth of experience in serving many of the top clients in the commercial office sector, retail, industrial and residential communities. He sits on the board for CALSAGA and BOMA L/A, is an active member of BOMA/GLA Emergency Preparedness Committee and helped create the highly publicized BOMA Safe and Secure Los Angeles security company accreditation program that formed in 2005. He participated in the implementation of California’s new security guard training law (SB2880) that passed in 2004, enhancing the training for all security guards statewide. He is an active member of BOMA, ICSC, CAI, IREM, IFMA, ASIS, CIDA and NAIOP, and CALSAGA trade associations throughout the state.</p>

He has managed and consulted on disasters throughout the United States. David is a Certified Property Manager and a Certified Business Resilience Manager. He speaks regularly at restoration and insurance industry events and is an accredited Continuing Education instructor in five states.</p>

<p>Dr. Lauria’s accomplishments have spanned across military, law enforcement, academia, and corporate worlds. He currently serves as Public Safety Director for Pittsburgh Technical Institute and the Chief of Police in Oakdale. Dr. Lauria is responsible for birthing the school’s Criminal Justice, Safety and Security Program, which is currently growing into one of the most respected programs of its kind. He is also a Pennsylvania State Constable and Consultant for companies and organizations in need of internal and external cultural and leadership effectiveness.</p>
<p>Dr. Lauria is a retired Lieutenant Colonel of the United States Air Force with over 20 years of service earning numerous military awards and decorations. His service included such positions as Director of Productivity and Quality; Logistics Management Officer; Chief of Staff during Desert Shield and Desert Storm; Commander of Airbase Security, Helicopter Crewman and Door Gunner during the Vietnam War; as well as Master Trainer.</p>
<p>Currently, Dr. Lauria has over 1,800 hours of military, police, and civilian training in such areas as law enforcement, emergency operations, incident command, nuclear-chemical-biological warfare, emergency-operational-strategic planning, organizational development and behavior, total quality management, conflict resolution, mediation, hostage negotiations, team building, leadership, and operations management.</p>
<p>In addition to Dr. Lauria’s position at Pittsburgh Technical Institute, his vast teaching experience includes his role as Adjunct Professor at Robert Morris University and Duquesne University. His teaching experience as a Workforce Trainer has been utilized at Allegheny County Community College, Slippery Rock University, Local-State-Federal government agencies, civic groups, and non-profit organizations.</p>
<p>Dr. Lauria has authored many publications on subject matters involving military leadership, problem solving, teaming, and process improvement. Dr. Lauria has published study guides, teaching curriculum, strategic plans, and articles used by such establishments as schools, the National Guard, and the Air Force Reserve.</p>
<p>Dr. Lauria received his Ed.D. in Education from Nova Southeastern University, Ft. Lauderdale, Florida with a concentration in Adult Education. His M.A. in Regional Planning was received at California University of Pennsylvania, California, Pennsylvania and he received his B.S. in Criminal Justice from Edison State College, Trenton, New Jersey.</p>

<p>Dr Sam Chandan is President and Chief Economist of Chandan Economics and Professor in the Associated Faculty of Real Estate at the Wharton School of the University of Pennsylvania. A noted economist and active policy commentator, Dr Chandan is amongst the commercial real estate industry’s leading voices in relation to capital and credit markets and the dynamic relationship between the economy, regulation, and market performance.</p>
<p>Dr Chandan received the PhD in Applied Economics from the Wharton School and was a doctoral scholar at Princeton University. In addition to his current teaching in the fields of Real Estate Finance, Public Policy, and Business Economics at Wharton, he has served as a visiting professor in the Economics Department at Dartmouth College.</p>

Xceligent, was formerly with Loopnet but ordered to be spun off as a condition of the merger between Co-Star and Loopnet. Doug talks about the origins of Xceligent, its relationship with Loopnet, how and why Loopnet had to divest itself before merging with Co-Star and what Exceligent is planning for the future.</p>
<p>If you have never heard of Xceligent, you will. It has been gathering and providing detailed information on buildings in the United States in a similar fashion to Co-Star and now it is moving into the commercial real estate listing business as a direct competitor to Loopnet. <p>My wife and I will be attending this event.  So you might want to ask, why is my wife accompanying me into Los Angeles, when we are so busy with our family and work that we can barely spend the time.  Well it is simple:</p>
<p>As I have mentioned, the theme of this show is &#8220;The Art of Balance&#8221;.  I am continuously amazed by my wife who not only does 90% of the home work taking care of our three kids and yours truly, but she works full time at her own business.  I can&#8217;t hold a candle to her; her energy and her ability to cope with everything.  While I can think of better ways to honor my wife, and while she is neither involved in commercial real estate nor is she an honoree of the event, she and I will be standing, listening to the speakers and knowing, in our own little way that she is a very special person and can handle the balance better than anyone that I know.</p>

				<content:encoded><![CDATA[<p>During this show, we will be discussing numerous issues that retail and office tenants need to consider and pay attention to when negotiating and administering their leases.  All of our featured guests will be speaking at this years NRTA Annual Conference in Palm Desert, California from between October 7-10, 2012. In many instances my guests and I will go into some depth regarding the topics that will be presented at the NRTA conference, including, but not limited to:</p>
<ul>
<li>The differences and similarities between the administration of an office or retail lease and some of the special considerations and concerns in mixed-use properties.  There will be a whole new office administration track at this years conference;</li>
<li>How over 3,000 The Gap, Old Navy, Banana Republic and Athleta stores and outlets insure that their landlords include only the most cost efficient vendors and services in cam charges, including utilities and trash. This will be a fun &#8220;trash talking&#8221; discussion with Debbie Ravel, Director of Landlord Audit from the Gap;</li>
<li>How to make sure that your landlord is adhering to the language of the lease;</li>
<li>Debbie Ravel will be briefly describing her presentation at the conference on Co-Tenancy and Occupancy Requirements of Leases and current considerations;</li>
<li>Gregg Ankenman will discuss construction issues and work letters as well as other financial issues that are more prevalent in today&#8217;s economy and which should be of concern to tenants who are expecting to receive a tenant improvement or construction allowance from their landlord.  Gregg has a great title for his presentation at the conference.  It&#8217;s called &#8220;Build a Store.&#8221;  Sounds a little like &#8220;Build a Bear&#8221; to me.  With Gregg at the conference will be a panel that will include a construction expert, attorney and architect;</li>
<li>There will also be considerable discussion during the show and conference about retailers who are going &#8220;Green&#8221; in a cost effective fashion.</li>
<li>Mez Birdie will describe the entire 8-course real estate track at the conference, including a mock in-house retail real estate committee meeting. Mez and I have a lively discussion regarding, among other things, out-sourcing real estate department to third party companies.  Outsourcing may be a great way to bring big time professional real estate management to smaller retailers;</li>
<li>Jennifer Romano and I discuss lawsuit and litigation issues for tenant&#8217;s and some of her Top 10 List of Things Retailers Shouldn&#8217;t Do before a lawsuit; and</li>
<li>Last but not least, Paul Kinney, the Executive Director and co-founder of the NRTA will give a quick (quick for Paul), description of what will be presented at this years conference and what is different this year from prior years.</li>

<p>Rod is a dynamic, articulate and knowledgeable speaker and considered by many as, America&#8217;s leading commercial real estate brokerage coach.</p>
<p>Listen while we have a pleasant, yet informative, &#8220;chit chat,&#8221; about Rod, his book, what it took to write the book and some of the top traits that he has identified from his nearly 1,000 interviews.</p>
<p>As is typical of our shows, we will go into some detail as to the meaning of these traits and not just give you a list.  We want to have a discussion that will give some meaning to the listeners so that our listeners might take something away from the discussion and apply lessons learned to make themselves more successful.</p>

<p>Rod possesses over 20 years of commercial real estate industry experience, a solid financial background and a proven growth track record that has repeatedly led to increased individual and company revenue.</p>

<p>Prior to creating the Massimo Group, Rod served a variety of roles in the commercial real estate industry including broker, owner, manager and executive level management for local, regional and national brokerage organizations.  His most recent position was Executive Vice President of Sperry Van Ness where he was responsible the general oversight of the organization’s franchise operations and the productivity of its 800 advisors.</p>
<p>Rod earned a Masters of Business Administration from Fuqua School of Business, Duke University, in Durham, North Carolina. He also earned a Bachelor of Arts in Commerce from Washington and Lee University in Lexington, Virginia.  He is a featured guest lecturer at the Fuqua School of Business, as well as the Kennan-Flagler Business School, at the University of North Carolina at Chapel Hill.</p>

<li>Our interview with Jon Mills, founder of <a href="http://www.motionloft.com/" target="_blank">Motion Loft</a> is a perfect example of the advantage of radio and hearing things for yourself rather than second hand. The way his sensors stream activity in real-time was first described to me by my staff, I first thought it was nothing more than a vehicular traffic sensor; those little boxes at the curb with the cable extending out into the street. As a result of my conversation with him, I understood that his sensor did a whole lot more. Jon&#8217;s computerized sensor can measure &#8220;foot&#8221; traffic, not just vehicular traffic.</li>

<p>This is the first of two shows reviewing this years RECon. The second show will be made available as a podcast within the next two weeks. The only reason why we covered Recon in two shows is that this year, we just had too many interesting interviews. 		<description><![CDATA[This show will address some of the key issues faced by property managers and attorneys who represent lenders/buyers after the purchase of a commercial property after foreclosure. This wouldn't be an interesting topic if we discussed it in 2004, when there were minimal commercial property foreclosures, if any.  However, in today's economy, a lot of properties are purchased as a result of a foreclosure, rather than by agreement between the owner and seller.  Purchasing commercial property through a foreclosure sale poses some interesting and significant issues and problems as well as  opportunities for investors, property managers and attorneys.]]></description>
				<content:encoded><![CDATA[<p>This wouldn&#8217;t be an interesting topic if we discussed it in 2004, when there were minimal commercial property foreclosures, if any.  However, in today&#8217;s economy, a lot of properties are purchased as a result of a foreclosure, rather than by agreement between the owner and seller.  Purchasing commercial property through a foreclosure sale poses some interesting and significant issues and problems as well as  opportunities for investors, property managers and attorneys.</p>
<p>Further complicating everyone&#8217;s job are situations in which the buyer is the lender, foreclosing on the property.</p>
<p>This show will address some of the key issues faced by property managers and attorneys who represent buyers after the purchase of a commercial property after foreclosure.</p>
<p>While property managers and the owners attorney have the same general responsibility to maximize revenue, profit and value of the property, their focus is a little different.  So we have invited some very experienced professionals to provide the property manager and leasing brokers perspective.</p>
<p>Featured guests for this show will be Kevin Cavanaugh, Chief Operating Officer and Jim Patton, Director of Leasing &amp; Acquisitions, both of NewMark Merrill Companies, reported as one of the fastest growing private companies since 1997. Newmark Merrill is a real estate, acquisition, development, property management and leasing company focusing on retail and shopping center properties.</p>
<p>Kevin P. Cavanaugh is a member of the American Institute of Certified Public Accountants, California Society of Certified Public Accountants, California Bankruptcy Forum, International Council of Shopping Centers, Association of Insolvency and Restructuring Advisors and the California Receiver&#8217;s Forum. Mr. Cavanaugh is currently a member of Bay Area Bankruptcy Forum, serving as Treasurer and serves as President of the CA Receiver&#8217;s ForumBay area chapter board. Since 1983, Mr. Cavanaugh has been involved in over 500 transactions totaling in excess of 1.25 billion in retail sale and lease transactions.</p>
<p>As NewMark Merrill&#8217;s Director of Leasing and Acquisitions, Mr. Patton is responsible for acquiring existing shopping centers for the company, as well as securing management contracts, and sourcing raw land for development. Additionally, Mr. Patton directs small to midsize tenant leasing for NewMark Merrill&#8217;s 42 Southern California properties. Mr. Patton has over 18 years experience in the commercial real estate industry, beginning his career under the direction of Mr. Sigal at West Venture Companies in 1991. As Director of Business Development for West Venture&#8217;s commercial division, Mr. Patton added over 1 million square feet of retail space to the company portfolio.</p>

<p>During this conversation, we will be exploring the reasons why these bills have been proposed, why federal the federal government has gotten involved in, what seems to be state taxation issues, who benefits from this legislation and whose interests will be most negatively effected.</p>
<p>The current legislation before congress includes the Main Street Fairness Act and the Marketplace Fairness Act, while the house has introduced the Marketplace Equity Act.  All three pieces of legislation propose methods of simplifying the taxation of Internet sales process so that Internet retailers may comply with state taxation requirements while avoiding the significant burden of complying with numerous and differing state requirements.  Proponents assert that the legislation does not impose any new tax but merely simplifies the process of compliance of state Use Tax codes, (We will discuss during the show what the difference is between a Use Tax and a Sales Tax).  Proponents also argue that these bills will allow cash strapped states and cities to generate more revenue from Internet sales, which were unintentionally excluded from older sales tax legislation as constitutionally interpreted by the United State Supreme Court. Detractors argue, among other things that passage of these bills would effectively impose a new tax on, already overburdened taxpayers.</p>
<p>This show is not an endorsement of the proposed legislation, but is an attempt to air out and fully express both sides of the argument so that our legislators and listeners can make the best-informed decision possible.</p>

<p>We are going to cover these and other issues pertinent to receiverships and commercial property during this show with our featured guest, <a href="http://www.mosierco.com/">Bob Mosier</a>, national speaker and one of the most preeminent receivers in Southern California. Participating in the discussion will be Kirk Rense, an attorney who has worked with Bob for over 20 years, focusing on receivership legal issues and Mike Walters, a long time specialist in commercial auctions.</p>
<p>As usual, this show is going to be more of a discussion over a cup of coffee among highly experienced and articulate people familiar with commercial property and receiverships.</p>
<p>Robert P. Mosier is President and Chief Executive Officer of Mosier &amp; Company. His specialty for the past thirty-five years has been turnarounds and dissolutions. For the past twenty-five years, these skills have been applied as a Court-appointed fiduciary in State and Federal Court and Federal Bankruptcy Court.</p>
<p>Total Court/fiduciary assignments since 1985 exceed 535 cases. In April 2009, Mr. Mosier was appointed as a regulatory Receiver to oversee the shutdown and windup of Private Equities Management Group (PEMG). The appointment was made in response to an SEC complaint in the United States District Court in Los Angeles. The SEC complaint alleges fraud and Ponzi-like management of approximately $1 billion worth of investment. The major investors include six banks in Taiwan.</p>
<p>Mr. Mosier is Co-Founder of the California Receivers Forum and serves as President of the State Organization. He is also the Publisher of Receivership News, a quarterly journal distributed to California Federal and State Judges in addition to the practitioners of the insolvency community. Mr. Mosier has served as the Co-Chair for three educational programs at Loyola Law School from 2000 to 2009 that focus on the nuances of receiverships. Loyola IV will take place in January 2011. Each is a two-day education session where top Receiver, lawyers, accountants and Judges provide insight into the area of receiverships with the goal of raising the level of professionalism. 				<content:encoded><![CDATA[<p>Wouldn&#8217;t it be nice if you never had a lease dispute or disagreement? No one can write a lease so that a dispute never arises.  But a lease can be written to minimize or eliminate disputes that most often arise and for those that can&#8217;t be avoided, method to resolve the dispute fairly, timely and effectively can be included.  In my opinion Collaborative Arbitration provisions are the way to go.</p>
<p>Everyone is looking for a way to resolve disputes that invariably arise in the context of commercial leases and you have all heard about the benefits of mediation and arbitration. <p>Our discussion is intended to be particularly meaningful to the investor, property manager, lender or broker, &#8220;on the street&#8221; and &#8220;in the trenches&#8221;.  What does all of this economic &#8220;mumbo jumbo&#8221; mean to how you run your business and how to plan for the future of your real estate investment, lender or brokerage practice.</p>
<p>Learn how an experienced economist actually looks at data and information and translates it in a meaningful way for commercial property professionals.</p>
<p>Dr Sam Chandan is President and Chief Economist of Chandan Economics and an adjunct professor at the Wharton School of the University of Pennsylvania. A noted economist and active commentator on issues of national and global economic significance, Dr Chandan is amongst the commercial real estate industry’s leading voices in relation to capital and credit markets and the dynamic relationship between the economy, regulation, and market performance.</p>
<p>In his academic and private sector roles, Dr Chandan has served as an advisor to a wide array of the nation&#8217;s banks and non-bank lenders, securitized debt market participants, investors, and policy makers.</p>
<p>Dr Chandan received the PhD in Applied Economics from the Wharton School and was a doctoral scholar at Princeton University. In addition to his current teaching in the fields of Public Policy and Real Estate Finance at Wharton, he has served as a visiting professor in the Economics Department at Dartmouth College.</p>

<p>This is the first in a series of commercial real estate tech shows in which I will have the opportunity to discuss one of my favorite avocations, technology and gadgets.</p>

<p><a href="http://www.rateblend.com/" target="_blank">Rateblend</a> is a simple commercial real estate web-based calculator, in which you enter the property and financial details of your transaction to quickly calculate effective rents. All without need to download or install spreadsheet software. It is accessible anywhere you have an internet connection.  We will be discussing Rateblend with it&#8217;s creator Andrew Bermudez and experienced commercial real estate broker with Lee &amp; Associates.<br />
